We begin by setting out the posision dubbed 'Fregean descriptivism', that Kripke attributed to Frege. We then set out various descriptivist theses. We proced to argue that Kripke’s interpretation of Frege as a reference-fixing descriptivist stems from his ascription of two other views, each logically weaker than reference-fixing descriptivism itself, to Frege. These are sense descriptivism and the view that sense fixes reference. The meaning descriptivism and the reference-fixing descriptivism of Kripke’s Frege have sense descriptivism as their common, logically weaker, (...) core. Modern analytical political philosophy—characterized most notably by the work of John Rawls—has had very little to say about how punishment in particular and criminal law more generally might be justified. This is a puzzling omission, as punishment can be seen as the most serious use of coercive state power and therefore the one in greatest need of philosophical justification. With the idea of filling this gap, this chapter analyzes several major political theories of recent decades and examines how criminal justice (...) might fit into their thought. After discussing the various political theories of libertarianism, liberalism, communitarianism, Marxism, and republicanism, I offer a limited defense of one such theory, Rawls’s “political liberalism,” as offering a suitable way to approach issues of criminal justice and punishment in modern society. More broadly, my chapter invites political philosophers to speak more often and more specifically about how criminal justice fits within their theories. (shrink)

In this case analysis deception or lying to a dying patient is discussed within the context of different relationships: the relationship between the patient and her family doctor, the relationship between the patient and the surgeon and the relationship between the patient and her family. It is suggested that the principle of veracity is not only a core feature in the patient-doctor relationship but is also fundamentally connected with the basic element of trust between the patient and doctor. The surgeon, (...) in deceiving the patient, even at the request of her husband, betrayed her trust in violating the principle of veracity. The primary responsibility of the surgeon was towards his patient rather than her family. The study of church growth has historically been divided into two strands of research: the Church Growth Movement and the Social Science approach. This article argues that Dunbar’s Social Brain Hypothesis represents a legitimate and fruitful third strand in the study of church growth, sharing features of both previous strands but identical with neither. We argue that five predictions derived from the Social Brain Hypothesis are accurately borne out in the empirical and practical church growth literature: that larger congregations (...) lead to lower active engagement from members; that single-leader congregations are limited to around 150 members; that congregations of 150 are further stratified into smaller functioning groups; that congregations expanding beyond 150 members undergo internal tensions and are forced to reorganise; and that congregations larger than 150 will require structural sub-divisions to retain active member involvement. While these assertions are reflected in the church growth literature and articulate the common sense assumptions of church growth experts, the Social Brain Hypothesis offers a coherent theoretical framework which unifies these observations and thereby represents a distinctive contribution to church growth studies. Protestant Christian ethicist Timothy Jackson and secular feminist philosopher Eva Feder Kittay each explore the relationship between love or care and justice through the lens of human dependency. Jackson sharply prioritizes agape over justice, whereas Kittay articulates a more complex and integrated understanding of the relationship of care and distributive justice. An account of Christian love and its relation to justice must account for the gratuity, mutuality, and reciprocity that pervade human existence. Such an account must integrate provision for another's (...) basic needs, a feature of agape, with a distributive justice that fairly allocates the material prerequisites of care and the burden of caring labor. Kittay's treatment of care and justice is more adequate to the realities of human embodiment and the social organization of care than Jackson's, but neither offers a fully adequate ground for the moral personhood of all human beings, including deeply dependent persons. We present a model for several early stages of the sensorimotor transformations involved in targeted arm movement. In psychophysical experiments, human subjects pointed to the remembered locations of randomly placed targets in three-dimensional space. They made consistent errors in distance, and from these errors stages in the sensorimotor transformation were deduced. When subjects attempted to move the right index finger to a virtual target they consistently undershot the distance of the more distal targets. Other experiments indicated that the error was (...) in the sensorimotor transformation rather than in the perception of distance. The error was most consistent when evaluated using a spherical coordinate system based at the right shoulder, indicating that the neural representation of target parameters is transformed from a retinocentric representation to a shoulder-centered representation. According to the model, the error in distance results from the neural implementation of a linear approximation in the algorithm to transform shoulder-centered target parameters into a set of arm orientations appropriate for placing the finger on the target. The transformation to final arm orientations places visually derived information into a frame of reference where it can readily be combined with kinesthetically derived information about initial arm orientations. The combination of these representations of initial and final arm orientations could give rise to the representation of movement direction recorded in the motor cortex by Georgopoulos and his colleagues. Later stages, such as the transformation from kinematic to dynamic parameters, or to levels of muscle activation, are beyond the scope of the present model. (shrink)

THE RECENT CONVERSATION WITHIN CHRISTIAN ETHICS ABOUT THE RELAtionship between universal obligations and particular, intensive relations—between agape and "special relations"—largely accepts Gene Outka's formulation that these are separate and competing moral claims that must be balanced within the Christian moral life. I examine the relationship between agape and special relations through the lens of dependency and dependent-care relations. Attention to dependent care and the material needs addressed within them raises questions about the sharp division between universal and particular obligations. Drawing (...) on the work of feminist philosopher Eva Feder Kittay, I argue that an adequate understanding of Christian love must take account of both our fundamental human equality and the pervasiveness of dependency in human life. Such an understanding of Christian love reveals that agape is a matter of personal and social ethics. (shrink)

Since World War II, US Catholic anti-abortion discourse has been framed in term of rights-language, ascribing civil and human rights to the prenate from the moment of conception. Yet many of those who would criminalize abortion have allied with anti-democratic political movements that buttress White supremacy and threaten civil rights. This contradiction exposes the theoretical inadequacy and epistemological hubris of current Catholic abortion discourse. While the Catholic Church and individual Catholics may subscribe to absolute moral norms against abortion, they should (...) not leverage rights-language to legislate such norms in a pluralistic democracy. Instead, Catholics should draw on our rich tradition of virtuous practical reasoning for an abortion ethic that honors the moral agency of pregnant persons and democratic citizens. (shrink)

There is a great deal of research on the structure of narrative and its mode, and on the narrative positioning and counter positioning of the actor in legal and social contexts. In offender narratives, personal experiences are embedded for observation and analysis of particular realities that contextualize a disposition of the perpetrator being ‘an undergoer’ rather than an ‘effector’ of actions. This is evaluated in the shift from a narrated action to a speaker utterance in prospection and also in anticipation (...) of the criminal act. Using ‘grammatical logic’, it is also possible to demonstrate how the crucial event is not a cause, but an effect of a personal theme that encapsulates pattern of circumstances when the narrative outcome in criminal narrative becomes the product of its discursive practices. This is the ‘story of intentionality’ in crime narratives, characteristically embedded within the 1st the story of crime, the 2nd is the story of investigation [14, 20]. Using techniques from functional grammar and critical stylistics for discourse analysis, I intend to show an effective approach for the search of offender theme that underlies an act of crime. These disciplines provide the analyst with the linguistic material to analyse intersentential cohesion in a chain of semantically linked sentences that explore the ways in which things are ‘made to look’ in the structure and functions of the English language. As a case study, I am using an offender narrative from Tony Parker’s book Life After Life: Interviews with Twelve Murderers showing an effective approach for the search of personal themes underlying the act of crime. Offender theme analyses are also valuable for evaluating the changing nature or development of offender characteristics pre or post crime. (shrink)

Methodological triangulation is the use of more than one method to investigate a phenomenon. Nurse researchers investigate health phenomena using methods drawn from the natural and social sciences. The methodological debate concerns the possibility of confirming a single theory with different kinds of methods. The nursing debate parallels the philosophical debate about how the natural and social sciences are related. This article critiques the presuppositions of the nursing debate and suggests alternatives. The consequence is a view of triangulation that permits (...) different methods to confirm a single theory. The article then explores the consequences for the philosophy of social sciences. (shrink)

Subjects were placed in a simulated scientific discovery context by first teaching them how to use an electronic device and then asking them to discover how a hitherto unencountered function worked. To do this task, subjects had to formulate hypotheses based on their prior knowledge, conduct experiments, and evaluate the results of their experiments. In the first study, using 20 adult subjects, (...) we identified two main strategies that subjects used to generate new hypotheses. One strategy was to search memory and the other was to generalize from the results of previous experiments. We described the former group as searching an hypothesis space, and the latter as searching an experiment space. In a second study, with 10 adults, we investigated how subjects search the hypothesis space by instructing them to state all the hypotheses that they could think of prior to conducting any experiments. Following this phase, subjects were then allowed to conduct experiments. Subjects who could not think of the correct rule in the hypothesis generation phase discovered the correct rule only by generalizing from the results of experiments in the experimental phase.Both studies provide support for the view that scientific reasoning can be characterized as search in two problem spaces. By extending Simon and Lea's (1974) Generalized Rule Inducer, we present a general model of Scientific Discovery as Dual Search (SDDS) that shows how search in two problem spaces (an hypothesis space and an experiment space) shapes hypothesis generation, experimental design, and the evaluation of hypotheses. The model also shows how these processes interact with each other. Finally, we interpret earlier findings about the psychology of scientific reasoning in terms of the SDDS model. (shrink)

Rawls's “public reason” has not been without its critics. One criticism is that public reason is “conservative.” Public reason must rely on those beliefs that are “widely shared” among citizens. But if public reason relies on widely shared beliefs, how can it change without departing from those beliefs, thus violating public reason? In part one of my essay, I introduce the conservatism objection and describe two unsatisfactory responses to it. Part two argues that there are aspects of public reason which (...) diminish the force of the conservatism objection: first, that public reason is historical, and second, that it is mutable. This paper examines social network size in contemporary Western society based on the exchange of Christmas cards. Maximum network size averaged 153.5 individuals, with a mean network size of 124.9 for those individuals explicitly contacted; these values are remarkably close to the group size of 150 predicted for humans on the basis of the size of their neocortex. Age, household type, and the relationship to the individual influence network structure, although the proportion of kin remained relatively constant at around 21%. (...) Frequency of contact between network members was primarily determined by two classes of variable: passive factors (distance, work colleague, overseas) and active factors (emotional closeness, genetic relatedness). Controlling for the influence of passive factors on contact rates allowed the hierarchical structure of human social groups to be delimited. These findings suggest that there may be cognitive constraints on network size. (shrink)

This article aims to read feminist new materialisms (Barad), together with ‘postulated’ linguistic or cultural primacy of Queer Theory (Butler), to show how both are engaged in similar critical-ethical endeavours. The central argument is that the criticism of Barad and new materialisms misses Butler’s materialistic insights due to a narrow interpretation of Butler's alleged social-constructivist position. There is, therefore, a specific focus on where they both make similar ethical appeals. Moreover, the article relies on Adorno's negative dialectic to highlight an (...) interpretation of Barad and Butler as being part of the same dialectical movement, in which materialism and idealism fluctuate in their mutual criticisms, thus continuing the procession towards 'new knowledge' and emancipation, or freedom, through their motions back and forth. A family reconstitution study of the Krummhörn population (Ostfriesland, Germany, 1720–1874) reveals that infant mortality and children’s probabilities of marrying or emigrating unmarried are affected by the number of living same-sexed sibs in farmers’ families but not in the families of landless laborers. We interpret these results in terms of a “local resource competition” model in which resource-holding families are obliged to manipulate the reproductive future of their offspring. In contrast, families that lack resources have no need to manipulate their (...) offspring and are more likely to benefit from allowing their offspring to capitalize on whatever opportunities to reproduce present themselves. Group size is a function of relative neocortical volume in nonhuman primates. Extrapolation from this regression equation yields a predicted group size for modern humans very similar to that of certain hunter-gatherer and traditional horticulturalist societies. Groups of similar size are also found in other large-scale forms of contemporary and historical society. Among primates, the cohesion of groups is maintained by social grooming; the time devoted to social grooming is linearly related to group size among the Old World monkeys and (...) apes. To maintain the stability of the large groups characteristic of humans by grooming alone would place intolerable demands on time budgets. It is suggested that (1) the evolution of large groups in the human lineage depended on the development of a more efficient method for time-sharing the processes of social bonding and that (2) language uniquely fulfills this requirement. Data on the size of conversational and other small interacting groups of humans are in line with the predictions for the relative efficiency of conversation compared to grooming as a bonding process. Analysis of a sample of human conversations shows that about 60% of time is spent gossiping about relationships and personal experiences. It is suggested that language evolved to allow individuals to learn about the behavioural characteristics of other group members more rapidly than is possible by direct observation alone. (shrink)

To acquire one’s native phonological system, language-specific phonological categories and relationships must be extracted from the input. The acquisition of the categories and relationships has each in its own right been the focus of intense research. However, it is remarkable that research on the acquisition of categories and the relations between them has proceeded, for the most part, independently of one another. We argue that this has led to the implicit view that phonological acquisition is a “two-stage” process: Phonetic categories (...) are first acquired and then subsequently mapped onto abstract phoneme categories. We present simulations that suggest two problems with this view: First, the learner might mistake the phoneme-level categories for phonetic-level categories and thus be unable to learn the relationships between phonetic-level categories; on the other hand, the learner might construct inaccurate phonetic-level representations that prevent it from finding regular relations among them. We suggest an alternative conception of the phonological acquisition problem that sidesteps this apparent inevitability and acquires phonemic categories in a single stage. Using acoustic data from Inuktitut, we show that this model reliably converges on a set of phoneme-level categories and phonetic-level relations among subcategories, without making use of a lexicon.
